Terms and conditions

These general terms explain how you may use Khayati to browse, order, pay for, and receive tailoring products and services.

This page is a general information template for an online marketplace. It is not legal advice. Khayati will update these terms after legal review.

These terms are intended to align with general principles of United Arab Emirates law, including consumer protection and electronic transactions rules. They do not replace a lawyer-reviewed contract.

1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Khayati website, mobile applications, and related online services (together, the “Platform”).

By creating an account, placing an order, joining as a tailor, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

Khayati operates as an online marketplace that connects customers with independent tailors, tailor stores, and comprehensive tailors for ready-made and custom garments.

2. Who we are

References to “Khayati”, “we”, “us”, or “our” mean the operator of the Platform, with a listed presence in the United Arab Emirates (Abu Dhabi).

3. Eligibility and legal capacity

You must have legal capacity under UAE law to enter into a binding contract. In general, you should be at least 18 years of age, or acting with the consent and supervision of a parent or legal guardian where permitted.

If you use the Platform on behalf of a business, you confirm that you are authorised to bind that business to these Terms.

4. Accounts and accurate information

You are responsible for keeping your login details confidential and for all activity under your account.

You must provide true, current, and complete information, including your name, contact details, delivery address, and payment information.

We may suspend or close an account if we reasonably believe it is used in a fraudulent, abusive, or unlawful way.

5. Products, listings, and custom orders

The Platform may display ready-made items (such as abayas, kanduras, jalabiyas, and dresses) and custom tailoring services made to your measurements and specifications.

Product images, colours, fabrics, and descriptions are provided for guidance. Slight variations may occur due to fabric batches, screen display, or handmade finishing.

Custom tailoring is a made-to-order service. Once production has started according to your approved details, changes or cancellations may be limited, except where UAE consumer protection rules require otherwise.

Tailors listed on the Platform are independent service providers unless we clearly state otherwise. Khayati is not the manufacturer of every item sold through the marketplace.

6. Pricing, VAT, and payments

Prices are shown on the Platform and may be quoted in UAE Dirhams (AED) or another currency indicated at checkout. Applicable VAT or other taxes may be added in line with UAE tax rules.

We may use licensed payment service providers. You authorise us and those providers to process payment for your order.

An order is an offer to buy. A contract is formed when we or the relevant tailor confirm the order. If an item is unavailable, priced in error, or cannot be fulfilled, we may cancel and refund any amount already paid.

Promotions, coupons, and instalment options (if offered) are subject to their own conditions and may be withdrawn.

7. Orders, delivery, and risk

You are responsible for providing a complete and accurate delivery address and for being available to receive the order.

Delivery times are estimates. Custom pieces may take longer than ready-made items. Delays caused by incomplete measurements, courier events, or force majeure are not a breach by us where we have acted reasonably.

Risk in ready-made goods generally passes to you on delivery to the address you provided, unless a different rule applies under UAE law or the carrier’s terms.

You should inspect items on receipt and notify us of obvious damage or shortage within a reasonable time.

8. Cancellations, returns, and refunds

Ready-made products may be eligible for return or exchange if they are unused, in original condition, and returned within the period stated at checkout or in our refund policy, subject to hygiene and customisation exceptions.

Custom-made garments, personalised embroidery, and items cut to your measurements are generally non-returnable once production has begun, except for a material defect, non-conformity with the agreed specification, or where UAE consumer protection law gives you a mandatory right.

Approved refunds are typically returned to the original payment method within a reasonable period after we receive and inspect the item or confirm cancellation.

Nothing in these Terms is intended to limit rights that cannot be excluded under UAE Federal Law on Consumer Protection or other mandatory UAE rules.

9. Acceptable use

You must not misuse the Platform, attempt unauthorised access, upload harmful code, scrape data, post false reviews, or use the Platform for any unlawful purpose under UAE law.

You must not infringe intellectual property rights, harass other users, or submit measurements or content that you are not entitled to share.

10. Intellectual property

The Khayati name, logo, website design, and Platform content are owned by us or our licensors. You may not copy, sell, or commercially exploit them without written permission.

Designs, patterns, and photos uploaded by tailors remain their property. By uploading content, a tailor grants Khayati a licence to display that content on the Platform for operating and promoting the marketplace.

11. Platform role and liability

Khayati provides an online venue, tools, and payment facilitation. Tailors are responsible for the quality of their workmanship, the accuracy of their listings, and timely production, except where we have expressly accepted that responsibility.

To the fullest extent permitted by UAE law, we are not liable for indirect or consequential loss, loss of profit, or loss arising from a tailor’s delay or workmanship, except in cases of fraud, wilful misconduct, or liability that cannot legally be limited.

Our total liability for a claim relating to an order is generally limited to the amount you paid for that order through the Platform.

12. Electronic communications

You agree that contracts, notices, and records may be made and stored electronically, in line with general principles of UAE electronic transactions and trust services law.

We may contact you by in-app message, SMS, WhatsApp, or email using the details in your account.

13. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates.

The courts of Abu Dhabi, United Arab Emirates, have non-exclusive jurisdiction, without limiting any mandatory right you may have to bring a consumer complaint before a competent UAE authority.

We encourage you to contact us first so we can try to resolve a complaint in good faith.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Platform after an update means you accept the revised Terms, except where UAE law requires additional notice or consent.
